$1.3M Unanimous Premises Liability Verdict in Cuyahoga County

CLEVELAND, OH— A Cuyahoga County jury unanimously awarded $1.3 million to a woman who shattered her kneecap after slipping on a wet, unmarked floor at Mr. Hero in Brookpark, Ohio.

Cheryl Trout was the caretaker for her husband at the time, who was diagnosed with terminal cancer. When she slipped and fell, her kneecap shattered into more than half a dozen pieces, resulting in two surgeries. The injury had a catastrophic impact on both her and her husband, as she was forced to wear a knee immobilizer to keep her leg completely straight 24/7 for 10 weeks. Cheryl now has post-traumatic arthritis and will require a total knee replacement in the future.

$1.3M Unanimous Premises Liability Verdict in Cuyahoga County

For almost three years, the fast-food restaurant where Cheryl slipped and fell, denied there was any water on the floor whatsoever. Tittle & Perlmuter attorneys Katie Harris and Scott Perlmuter were able to give voiceto the truth in this trial and the jury validated everything this woman knows happened, and everything she has been through.

“We believed our client and fought for her from the moment we met her. This is what justice can look like when lawyers make the commitment to go all the way,” says attorney Katie Harris of Tittle & Perlmuter. “I am so grateful for my client that the jury rendered a verdict that says the truth matters, and it has been an honor to represent her.”
