Statute of Limitations for Personal Injury Cases

Under Oh. Rev. Code § 2305.10, all personal injury cases are subject to a standard two-year filing deadline. In most cases, if the claimant does not initiate lawsuit proceedings within two years of the incident date, they would be unable to collect damages. However, there are a few exceptions to this statutory deadline. For example, state law provides that if a potential claimant is under the age of 18 at the time they suffer losses, the deadline may be extended. In this situation, the two-year deadline would not commence until the plaintiff’s 18th birthday.
