When hourly Corrections Officers begin training at the Cuyahoga County Corrections Center, they are required to complete homework assignments during their training period without pay. Our Cleveland Wage & Hour attorney, Scott Perlmuter, filed a Class and Collective Action Complaint against the Cuyahoga County Corrections Center for this illegal pay practice (see Complaint below).
The complaint was filed in the name of Raymond Palmer, on behalf of himself and all others similarly situated. Trainees are required to finish assignments but are not given time to complete them on the clock. Because they are hourly employees, they should be receiving overtime pay for time spent working off the clock. This case challenges that pay practice and alleges that it violates the Fair Labor Standards Act (FLSA), 29 U.S.C. §§ 201-219, Ohio’s Prompt Pay Act, Ohio Rev. Code Ann. § 4113.15, and Ohio’s common law of unjust enrichment.
